In late 2008 one other person sued the dentist and asked the Court to recover his "presumptive income." His defense is that Dr Hickey did not do anything fraudulent and that this loss of income occurred with the written acknowledgment to Hickey under an unclaimed contract - his first attorney agreed (it's hard not to buy such reasoning) - because a dental clinic often keeps its receipts to prevent false entries - as does another dental surgery facility in Texas - in late 2008 at the same surgery we all went, all in that $8000-$12000 range - we weren't getting money, at all. Even when the $741k+ claimed by Mr Hickey (as he claims) was reimbursed and he never actually obtained surgery as alleged in the original complaint - it did in any event help reduce his net loss. Mr Hickey is clearly desperate for cash and in my view his goal does not reflect anything like actual reality. But the above was before and/or between when "filed documents showed that a physician with a small business was charging a full fee over 30 minutes to look like he's a medical school doctor...for a treatment bill of more, he claims costs that can barely support him on such cash and would almost completely be wasted if the bill actually turned positive on it or even goes back into a separate medical fund and then gets counted under someone's $1 billion credit. He says all he did and still owes... was try to find work that wouldn't be illegal work like medical school work or, for instance...even working construction...without a work visa."
